These terms apply when you buy or use Black Earth Biochar. Please read them before placing an order. By placing an order you confirm that you have read and accept them.
"Black Earth", "we", "us" and "our" mean Black Earth Biochar of Nairobi, Kenya. "You" means the person or organisation buying or using our biochar.
Orders are placed and paid for through the Green Cart platform. The Green Cart Terms also apply to your use of that platform. If those terms conflict with these terms on a matter about Black Earth Biochar, these terms apply.
Black Earth Biochar is a carbon-rich soil amendment made from organic biomass. It is not a chemical fertiliser and does not replace good farming practice, manure, compost or fertiliser where they are needed.
We describe our product and package sizes as accurately as we can. Images are for illustration, and natural variation in colour, particle size and moisture is normal.
Pickup. If you choose pickup, you will receive a pickup code once payment is confirmed. Bring the code to the selected shop to collect your order. Please collect within a reasonable time, and contact us if you cannot.
Delivery. If you choose delivery, we deliver to the county, sub-county and location you provide. Delivery times are estimates and may be affected by distance, weather, road conditions or other events outside our control. Someone must be available to receive the order at the location given.
Please check your order when you receive it. Risk in the product passes to you on collection or delivery.
If your order arrives damaged, is the wrong product or quantity, or is otherwise not as described, contact us within 7 days of collection or delivery with your order number and photos of the product and packaging. Where the issue is confirmed, we will replace the product or refund you for the affected part of the order.
This does not affect any rights you have under Kenyan consumer protection law.
Biochar can improve soil structure, water retention and nutrient use. However, results depend on soil type, climate, crop, rainfall, application rate and farm management. We do not guarantee any particular yield, income or soil test result.
Information about carbon storage is general in nature. Buying biochar does not by itself give you carbon credits or any right to carbon payments. Any carbon or SOC Program benefits are governed by the separate SOC Program terms and verification process.
Large farms, cooperatives, institutions, distributors and projects can request bulk pricing. Bulk orders are quoted individually and may have their own payment, delivery and cancellation terms, agreed in writing. If those agreed terms differ from these terms, the agreed terms apply.
To the extent permitted by law, our total liability for any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses, including loss of crops, yield, income or profit, or for delays and failures caused by events outside our reasonable control.
Nothing in these terms limits liability that cannot be limited under Kenyan law.
We use your personal information, such as your name, phone number, SOC number and delivery details, to process and deliver your order, handle payments and refunds, and contact you about your order. We handle it in line with the Kenya Data Protection Act, 2019. We share it only with those who need it to fulfil your order, such as the pickup shop, delivery partner or payment provider.
We may update these terms from time to time. The version shown on this page when you place an order is the one that applies to that order.
These terms are governed by the laws of Kenya. We will try to resolve any dispute with you directly first. If it cannot be resolved, it may be referred to the courts of Kenya.
